Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Accessibilify platform, website, and services (collectively, the “Service”) operated by Next Door Multimedia LLC (“Company,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Accessibilify is an AI-powered compliance walkthrough platform. The Service allows you to record video walkthroughs of properties using a smartphone or AI-enabled glasses, and uses artificial intelligence to analyze the footage for compliance with applicable safety and regulatory standards, including but not limited to foster home licensing requirements, ADA accessibility standards, OSHA workplace safety standards, and fire code compliance.

The Service generates compliance reports with findings, scores, and recommendations cited to specific regulatory standards.

2. Important Disclaimers

2.1 Not a Professional Inspection

The Service is an informational tool only. Reports generated by Accessibilify are not a substitute for a professional compliance inspection, legal advice, or an official determination by any licensing or regulatory authority. The Service is designed to help you prepare for inspections and identify potential compliance gaps, not to replace the judgment of qualified inspectors, attorneys, or regulatory bodies.

2.2 No Guarantee of Compliance

Passing an Accessibilify walkthrough does not guarantee that your property will pass an official inspection. Our AI analysis is based on visual information captured in video and may not detect all compliance issues. Some requirements cannot be assessed through video alone (e.g., water temperature, structural integrity, document verification). You are solely responsible for ensuring your property meets all applicable legal and regulatory requirements.

2.3 AI Limitations

Our AI models, while continuously improving, may produce false positives (flagging compliant items as non-compliant) or false negatives (failing to identify non-compliant items). Findings marked as “needs review” indicate that the AI could not make a confident determination and require your manual assessment.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5.1 Ownership

You retain ownership of all content you upload to the Service, including video recordings, floor plans, and property information (“Your Content”).

5.2 License Grant

By uploading content to the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, analyze, and display Your Content solely for the purpose of providing and improving the Service. This license terminates when you delete Your Content or your account.

5.3 Responsibility

You represent that you have the right to upload all content you submit to the Service and that Your Content does not violate the rights of any third party.

6. Intellectual Property

The Service, including its software, AI models, design, text, graphics, and branding, is owned by Next Door Multimedia LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

The compliance reports generated by the Service are provided for your personal or organizational use. You may share reports with relevant parties (e.g., licensing agencies, contractors) but may not resell or commercially redistribute them.

7. Fees & Payment

Access to the Service may be subject to fees as described on our pricing page. We reserve the right to change our pricing at any time with reasonable notice. If you are on a paid plan, you agree to pay all applicable fees. Failure to pay may result in suspension or termination of your account.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXT DOOR MULTIMEDIA LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

WITHOUT LIMITING THE FOREGOING, WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM: (A) YOUR RELIANCE ON AI-GENERATED COMPLIANCE FINDINGS; (B) THE FAILURE OF THE SERVICE TO DETECT A COMPLIANCE ISSUE; (C) ANY DECISION MADE BY A REGULATORY AUTHORITY REGARDING YOUR PROPERTY; OR (D) ANY ACTION YOU TAKE OR FAIL TO TAKE BASED ON INFORMATION PROVIDED BY THE SERVICE.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR THAT AI ANALYSIS RESULTS WILL BE ACCURATE OR COMPLETE.

10. Indemnification

You agree to indemnify and hold harmless Next Door Multimedia LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you upload to the Service.

11. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your account at any time for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

12. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Effective Date” above. Your continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Next Door Multimedia LLC regarding the Service and supersede all prior agreements and understandings.
